Eligibility requirements for a summary divorce

Ending a marriage is not something couples are going to do with ease. Whether the difficulties are due to one or both spouses emotions or because they are just not seeing eye to eye, most divorces take longer than expected to be granted. Should you and your spouse want to get a divorce and legally end your marriage, depending on the circumstances, you may be able to get what is known as a summary divorce and take advantage of its many benefits.

When seeking a summary divorce, couples must meet the following requirements:

  • The couple does not share any property.
  • The couple has been married for five years or less.
  • Spouses agree to not seek spousal support or alimony.
  • The couple does not have any natural or adopted minor children.

Qualifying for a summary divorce is something many divorcing couples would be happy about because there are several benefits to going with this option. Not only can they avoid spending a lot of time in court disputing with one another, but they can also avoid lengthy negotiations and tons of paperwork. Often, when a couple is eligible for this type of divorce, they go with this option and end the marriage as soon as possible.

Couples who want to end their marriage may do so amicably. They do not need to go through the long drawn out process that other couples have chosen. Even though it may be common for spouses to dispute, disagree and become stressed over the situation, this isn’t how it has to play out. There may be other, simpler ways to get divorced.
