Property division might not always be easy during divorce

by | Mar 8, 2019 | Property And Asset Division

Splitting up the property that was accumulated during a marriage is a challenge in some divorces. This is because both parties might have specific things they are attached to that they don’t want to let go. When both are attached to the same property, there can be a fight over who gets to keep it. But there is much more to property division than just trying to get the items you want.

One thing that you need to remember about property division is that everything has to be given a home. This includes small assets like the furniture and kitchen appliances and larger ones like the house, car, and retirement accounts. Property division even goes beyond that. You have to divide up the debts that were part of the marriage.

We know that this might sound like a lot, but it might not be so overwhelming if you take things one item at a time. It is often better to try to work through the larger assets first and then move on to the smaller ones. Once you have the assets finished, you can move to splitting up the debts. You can use these to balance things out.

There are sometimes circumstances that require even more thought. This is the case when you have a business that is part of the marriage. You then have to determine what is going to happen with it. This is a challenge, especially when neither person wants to sell the business, and both want to remain involved.

We know that you might not have a lot of energy to put toward the property division process. While we can’t make decisions for you, we can work to protect your rights and interests.
